DOJ tells court Ilhan Omar home search warrant is only partly carried out
Prosecutors say the warrant covers "other individuals" and will be fully executed "in short order." Omar, who has not been charged, has an attorney who calls the probe politically motivated.

The Justice Department told a federal court on Tuesday that a search warrant tied to Rep. Ilhan Omar, a Minnesota Democrat, has been only partly carried out. The warrant also extends to "other individuals," according to the department's filing 1.
The filing says "the United States expects that the warrant will be fully executed in short order." That could come before Election Day on Tuesday, Nov. 3 1.
What the filing says
The 47-page redacted document opposes a request by news outlets to unseal the records. Homeland Security Investigations agents searched Omar's Washington home at about 6:05 a.m. on Oct. 12 1.
Prosecutors said the supporting affidavit is "chock full of privacy interests." They asked for advance notice if the court decides to unseal it. They also signaled they could file an emergency motion to halt such an order while they appeal 1.

The filing says Attorney General Todd Blanche signed off on the warrant. According to the filing, he confirmed its timing did not have "the purpose of affecting any election." He also confirmed it was not meant to give an advantage or disadvantage to any candidate or party 1.
The wider investigation
Omar has long faced unproven allegations that her former husband, Ahmed Nur Said Elmi, is her brother. The allegations also say their marriage was meant to obtain immigration benefits. She has repeatedly denied them, and her attorney has called the investigation "politically motivated" 1.
After the search, Omar's office called it an "outrageous abuse of power." It said, "The Congresswoman has done nothing wrong." Federal authorities reportedly took her cellphone, notebooks and personal computers 2.
More than a dozen subpoenas were reportedly issued for grand jury testimony in Minnesota, including to some of Omar's relatives 2. Jeanine Pirro, the U.S. Attorney in Washington, said her office has several investigations into Omar. She said one is examining Omar's financial disclosures 2. Omar has not been charged with a crime.
Omar amended one financial disclosure. The office of congressional conduct, which reviews allegations involving House members and staff, cleared her of wrongdoing 2.
Why it matters
The Justice Department is describing an investigation that is still active, with more people in its sights, in the last week before a national election. The filing's own assurance about timing is the department's claim. A court has not tested it 1.
The warrant, the affidavit and the evidence behind it remain sealed. Until a judge rules on unsealing, voters cannot check what investigators told the court. They also cannot judge whether the case justifies a search of a sitting member of Congress this close to an election 12.
Next, the court must decide whether to unseal the records. If it does, prosecutors have signaled they would seek to pause that order 1.
