The Treasury Department on Thursday proposed rules to carry out a ban on large investors buying single-family homes. The ban is part of the 21st Century ROAD to Housing Act, a bipartisan housing package passed in July 13. The proposal is a draft, not a final rule 2.
Under the law, a "large institutional investor" is a company that controls at least 350 single-family houses and is in the business of owning, renting or managing them 3. Starting Jan. 7, 2027, such investors are generally barred from buying a single-family home, or contracting to buy one, unless the purchase falls under an exception 3.
What the draft says
The law exempts several kinds of purchases, including build-to-rent communities, renovate-to-rent projects and programs that help renters become owners 13. Treasury's draft would let investors buy purpose-built rental communities within 18 months of getting a certificate of occupancy 2. For renovate-to-rent homes, buyers would need to spend at least 15% of the purchase price on improvements 2.
Treasury also proposed a path for homes to keep trading between large investors, if the seller bought them in line with the law 2. The draft would also define when a company counts as a passive investor in another firm that owns homes 23. A prohibited purchase could bring a civil penalty of up to $1 million or three times the property's purchase price 2.

Treasury Secretary Scott Bessent said in a statement that the aim is a "fair shot at purchasing homes in their communities" for families, while "avoiding unnecessary disruption" in the housing market 1. Treasury says it plans to write the rules in phases because the time before the effective date is short 1.
Politics and what happens next
The law took effect without President Trump's signature. He protested the signing but did not veto it after Congress failed to pass the SAVE America Act, a bill to overhaul voter registration rules 1. In a January post, Trump said "People live in homes, not corporations." 1

Treasury is asking for public comment on whether 18 months is long enough for the rental-community exemption. It also asked whether the final rule should cover purchases made before the effective date 2. The coverage we reviewed did not give a comment deadline.
That matters because the size of the exemptions will decide how many homes the ban actually keeps off the market. The draft shows Treasury choosing to leave room for new rental construction and investor-to-investor sales. We could not confirm any Democratic reaction to the draft by publication time.
