Democrats' Congress takeover sets up health care fights over premiums, Medicaid and drug prices

With control of the House and Senate, Democrats say they will push to restore expired Affordable Care Act subsidies and roll back Medicaid cuts. President Trump's veto pen stands in the way, and health policy experts say the real battles will be oversight and negotiation.

Democrats' midterm victories give them control of the House and Senate in January, and with it leverage over health care: insurance premiums, prescription drug prices and Medicaid coverage, according to health policy experts and former White House advisers 1.

Any health legislation still needs President Donald Trump's signature. Before Tuesday's election, Trump said he would brand himself Mr. Veto if Democrats took Congress; on Wednesday he said he will probably get along with them 1.

Insurance subsidies first

House Minority Leader Hakeem Jeffries has said restoring the expired enhanced Affordable Care Act tax credits would be a top objective for Democrats in 2027 1. When the federal subsidies expired at the end of last year, millions saw monthly premium bills double or even triple, and about 3 million people dropped their coverage, the network reported 1.

Costs are expected to rise further in 2027, with ACA premiums jumping by double digits for a second year in a row 1. Larry Levitt, executive vice president for health policy at KFF, a nonpartisan health policy research group, said relief could be backdated to the start of 2027, meaning people who paid higher premiums would get the money back as a refund 1.

Medicaid work rules and the veto

Democrats also plan to push back on the Medicaid cuts in Trump's "big, beautiful bill," especially work requirements that are expected to strip coverage from millions of people because of paperwork and red tape rather than lack of employment 1. Several states have already begun implementing the requirements ahead of the national Jan. 1 deadline 1.

Last week a federal judge in Boston blocked a Centers for Medicare & Medicaid Services policy that would have forced "medically frail" patients and people with disabilities to prove they are too "significantly impaired" to meet the work mandates, and gave states an additional six months to implement a more lenient version 1. Levitt said Trump is bound to veto any bill rolling back the Medicaid cuts 1.

Drug prices and oversight

Democrats may find common ground with Trump on lowering prescription drug costs, said Dr. Ezekiel Emanuel, a special adviser for health policy during the Obama administration, pointing to Trump's discount drug website TrumpRx and his most favored nation pricing deals 1. Emanuel said he thinks there is probably a very big agreement you could reach with him 1.

With committee gavels, Democrats can hold hearings, demand documents and subpoena officials, including Health Secretary Robert F. Kennedy Jr. 1. The new majority will include three doctors who have criticized Kennedy: Senator-elect Annie Andrews of South Carolina, Senator-elect Abdul El-Sayed of Michigan and Representative-elect Richard Pan of California 1. Andrews called Kennedy an "archnemesis" to public health during her campaign 1.

Miranda Yaver, an assistant professor of health policy and management at the University of Pittsburgh, said oversight of the administration's health changes is coming 1. "We can absolutely expect to see a lot of oversight into these changes and unpacking what those harms are," she said 1.

Ten states have not adopted the full Medicaid expansion under the ACA, including Georgia, Texas and Wisconsin, which elected Democratic governors on Tuesday, and Kansas, where the race remains too close to call 1. Yaver was skeptical, noting that Trump's bill ended financial incentives that encouraged states to expand 1.

That matters because the fight will play out in two places at once: bills that need Trump's signature, and investigations that do not. Emanuel warned against overreach after a big win 1. "One of the dangers of big election victories is people get cocky and they overreach and they fail to deliver on what people actually care about," he said 1.
