Divided Ninth Circuit lets Idaho enforce abortion ban in health-risk cases

A 2-1 appeals court order freezes a ruling that protected one Idaho doctor treating women whose health, not only life, is at risk. The case could shape how far states can go in limiting emergency care for pregnant women.

A federal appeals court on Friday cleared Idaho to enforce its abortion ban against a doctor who wants to treat women whose pregnancies threaten their health, not just their lives 1. The 2-1 order from a panel of the Ninth U.S. Circuit Court of Appeals keeps a lower-court ruling frozen while Idaho's appeal goes forward 1.

What the lower court found

Dr. Stacy Seyb, a Boise specialist in high-risk pregnancies, sued Idaho officials in 2024 12. He wanted to perform abortions when a pregnancy poses a non-negligible risk of serious and lasting harm to a woman's health, even if it is not life-threatening 1.

After a trial, U.S. District Judge Lynn Winmill agreed in August 1. He wrote an 81-page ruling and barred Idaho from enforcing two state laws in those cases 1. The laws are the Defense of Life Act and the Fetal Heartbeat Act 1.

On Aug. 25, Winmill narrowed the order so it covers only Seyb, citing a 2025 Supreme Court decision limiting injunctions to the named plaintiffs 2. Idaho Attorney General Raúl Labrador asked the Ninth Circuit to freeze even that 13.

Why the majority sided with Idaho

The majority said Idaho is likely to win under the Supreme Court's 2022 decision in Dobbs v. Jackson Women's Health Organization, which overturned Roe v. Wade 1. It also said the state's interest in enforcing its law "clearly outweighs" the harm to Seyb from following it during the appeal 1.

On abortions sought because of suicide risk, the majority wrote that "There are other methods for preventing suicide" 1. Judge Consuelo Callahan joined the majority and said an intermediate appeals court is bound by Supreme Court decisions 1. She acknowledged the court may someday have to decide whether a state ban is so restrictive that it fails even the limited review left after Dobbs, but said that question was not before the panel 1.

The dissent

Judge Marsha Berzon dissented. She wrote that Dobbs ended the right to elective abortion but did not address the separate right, under Roe and Planned Parenthood v. Casey, to abortions needed to protect a woman's life or health 1.

some women with serious pregnancy complications will during the pendency of this appeal be required to continue their pregnancies at serious, permanent risk to their health.
Marsha Berzon, U.S. Circuit Judge, Ninth Circuit1

Labrador said in August that "We have appealed to the Ninth Circuit, and we will fight until this ruling is reversed and Idaho's law is restored." 3 His office and Seyb's lawyers did not immediately respond to requests for comment on Friday's order 1.

What happens next

The panel combined Idaho's appeals with Seyb's cross-appeal 1. The first brief is due Dec. 18, and the order says it will strongly disfavor requests for more time 1. It does not schedule oral arguments 1.

That matters because the stay is not a final ruling on the merits. But in practice, the ban applies in health-risk cases while the appeal runs, which Berzon warned could harm patients 1. Idaho's law allows abortions only in limited cases, such as rape, incest with a police report, or when the mother's life is in danger 3. Doctors who perform them outside those limits can face felony charges, loss of a medical license and up to five years in prison 3.

  4. First brief due in the consolidated appeals 1.
