Judge warns Trump's $10 billion BBC suit could be dismissed over thin document filing
A magistrate judge says Trump's lawyers turned over just 20 documents, nearly all already in the BBC's hands. She is questioning whether they searched properly and has set deadlines in November.

A federal magistrate judge has warned President Donald Trump that his $10 billion defamation lawsuit against the BBC could be thrown out. She says his lawyers have not produced enough relevant documents, or shown that they looked for them properly 1.
Trump sued over a BBC program that edited together two different parts of a speech he gave before the Jan. 6, 2021, Capitol riot. The BBC has apologized for the edit but denies defamation 1.
Twenty documents, mostly already in the BBC's hands
Trump's team had until Oct. 21 to confirm its written answers were accurate and hand over any relevant documents not in dispute. That stage is called discovery, when each side must share evidence 1.
Magistrate Judge Enjolique A. Lett said the response was "a mere twenty documents." She said all of them had either been produced earlier by the BBC or pulled from the internet in the days before the deadline 1.

She added that Trump's lawyers acknowledged they had not produced a privilege log. That is a list of documents held back because a lawyer says they are legally protected 1.
Given the nature of the requests, the paucity of the production, and the steps counsel undertook to ensure that all responsive documents were collected, the Court has concerns about whether an adequate search for all responsive documentation occurred
What the judge ordered
Lett ordered Trump's team to provide the privilege log by Nov. 5. Any remaining undisputed documents are due by Nov. 23 1.
The order warns that failing to comply could bring sanctions, up to dismissal of the case for failure to prosecute 1.
Failure to comply with this order may result in sanctions, including but not limited to, dismissal of this action for failure to prosecute this case
This is not the first time she has voiced doubts. At a hearing reported on Oct. 22, Lett said she tended to agree with the BBC that it strained credulity that a thorough search had been done 2.
At that hearing she also said Trump must sit for a deposition, meaning questioning under oath, by Dec. 11. The discovery deadline is Dec. 18, and she said she could not change it. Trump could ask the district judge overseeing the case to extend it 2.
Why it matters
The case tests whether a president who sues a news organization must follow the same evidence rules as everyone else. The BBC has issued at least 47 subpoenas to people in Trump's circle, and the judge backed its subpoena for Mar-a-Lago membership records 2.
BBC attorney Chuck Tobin said those records would test Trump's claim that the program harmed his professional reputation 2. In August, Trump amended his complaint to narrow the alleged harm to his personal reputation. He dropped the business and brand damages 2.
That matters because a suit this size can pressure a news outlet even if it never reaches trial. If the filings stay thin, the court has signaled it may end the case instead of letting it drag on 1.
Trump's lawyers have objected to a series of document requests and deposition questions. Lett has said she will rule on those objections in writing 2. The coverage we reviewed did not say whether Trump's team will appeal or how it will respond to the latest order.
The Record
- Deadline for Trump's team to confirm its discovery answers and produce undisputed documents; it produced 20 documents 1.
- Judge Lett said it strained credulity that a thorough search had been done, and said Trump must be deposed by Dec. 11 2.
- Deadline for Trump's team to provide a privilege log 1.
- Deadline for any remaining undisputed responsive documents 1.
