Missouri state Rep. Anthony Ealy, a Democrat, was arrested on Wednesday, one day after winning re-election to a third term in the Missouri House. Jefferson City police arrested him on a misdemeanor charge of fourth-degree assault and a charge of disturbing the peace, according to records Newsweek reviewed 1. He has not been convicted of anything, and the charges are allegations.

Cole County's jail records show the arrest at 11:57 a.m. Wednesday 1. The Kansas City Star reported that Ealy was still in the Cole County Jail on Thursday morning. It said court records did not yet show that prosecutors had filed charges 2. KOMU, a Missouri TV station, reported that police said charges were filed Thursday and that he was being held without bond 3.

What police and reports say

Reports differ on how to label the assault charge. Newsweek's review of the jail portal listed fourth-degree assault 1. The Kansas City Star said the portal listed fourth-degree domestic assault 2. Police have not publicly explained the difference in what we could find.

Police were called to a downtown Jefferson City apartment building around 11:30 a.m. Wednesday, the Kansas City Star reported. The paper said the arrest report describes threats made against the person who called police, and a reference to a gun 2. KOMU quoted a police news release saying witnesses described a man yelling outside a business and threatening someone 3. Ealy did not answer the Star's phone call or text message, and Newsweek said it had asked him and police for comment 12.

The Kansas City Star reported that the assault charge carries up to one year in jail and a $2,000 fine, and that disturbing the peace carries up to six months and a $1,000 fine 2.

Where his party stands

Marc Powers is chief of staff for the House Minority Leader's Office. He told ABC17 that Democratic leaders removed Ealy from all committees in the spring so he could focus on personal issues 1. The Star reported that the minority leader is Ashley Aune 2.

There are no plans to restore his committee assignments for the upcoming session.

Ealy is 32 and a lawyer from Grandview. He represents part of Jackson County, which includes much of the Kansas City area. He won Tuesday's race with 68% of the vote against Republican Dave Thomas 23.

What happens next

The next step is whether prosecutors formally file charges and when Ealy appears before a judge. The Missouri legislature's next session starts in January, and Ealy is set to be sworn in for his new term unless something changes. Whether he faces discipline beyond losing committee seats is not yet known.

That matters because Democrats are making accountability a central argument after their midterm wins. The pattern readers should watch is whether the party holds its own members to the standard it demands of Republicans. Leaders here acted months before the arrest. The case itself must now run through the courts.

The Record

  1. Ealy wins a third term in the Missouri House with 68% of the vote 2.
  2. Jefferson City police arrest Ealy at 11:57 a.m. on assault and disturbing-the-peace charges, per jail records 1.
  3. Police say charges were filed; Ealy remains in Cole County Jail without bond 3.
