Nevada voters write abortion rights into state constitution; it takes effect Nov. 24

Nevada voters approved Question 6 for the second and final time, with about 63% voting yes. Abortion rights before fetal viability move out of ordinary state law and into the constitution, which a governor and legislature cannot undo on their own.

Nevada voters have added abortion rights to their state constitution. Question 6 passed with about 63% of the vote in Tuesday's midterm election, and the Associated Press called the race early Wednesday, Nov. 4 246.

This was the measure's second trip to the ballot. Nevada requires amendments proposed by citizens to win a majority in two consecutive elections, and voters first approved Question 6 in 2024 45. The amendment becomes part of the constitution on Nov. 24, once the Nevada Supreme Court certifies the election results 1.

What changes on Nov. 24

Abortion was already legal in Nevada under a 1990 voter referendum 4. Current law allows abortion by a licensed physician through the first 24 weeks of pregnancy. After that, it is allowed when a physician reasonably believes it is needed to preserve the pregnant person's life or health 3.

The amendment bars state and local governments from interfering when a qualified health care professional performs an abortion before fetal viability. It also bars interference at any point when an abortion is needed to protect the patient's life or health 3. Viability is the point at which a fetus has a significant chance of surviving outside the womb without extraordinary medical measures, and the treating health care provider makes that call 1.

The bigger change is how hard the right will be to take away. Any future attempt to change or restrict abortion access would take another multiyear statewide vote 1. "It enshrines this protection in the constitution that makes it difficult to overturn later," said Neama Rahmani, president of West Coast Trial Lawyers 3.

Supporters also framed the vote as a promise to the region. "This will not only protect reproductive freedom for the Battle Born State," said Krystal Ortiz, campaign manager for Nevadans for Reproductive Freedom, a group supporting Question 6 3.

Why Democrats said a state vote mattered now

In June, on the fourth anniversary of the Supreme Court decision that overturned Roe v. Wade, Nevada Democrats held an event to promote Question 6 7. Sen. Jacky Rosen, D-Nev., tied the measure to actions by the Trump administration 7.

Mifepristone is the first of the two pills used in a medication abortion. At the same event, Rosen said, "And at the end of last year, Donald Trump's VA implemented a near-total abortion ban," referring to the Department of Veterans Affairs 7. State Senate Majority Leader Nicole Cannizzaro, D-Las Vegas, said, "This decision was made possible by the Trump administration's far-right Supreme Court appointments," speaking about the ruling that ended Roe 7.

That matters because a state amendment reaches only state and local government. Supporters' case was that Nevada should lock in its own protections while federal agencies move in the other direction.

A cross-party vote

Support went well beyond Democrats. A KFF survey of Nevada voters, done Oct. 28 through Nov. 3, found that about half of Republicans, 47%, voted yes 5. That included 44% of voters who backed the Republican candidate for governor 5. KFF is a nonpartisan health policy research group.

Ford, the state's attorney general, defeated Lombardo in the same election and will be Nevada's first Black governor. Lombardo conceded on Nov. 4 8.

Lombardo's record on reproductive health is mixed. He vetoed a bill meant to protect in vitro fertilization, or IVF, and expand insurance coverage for it, saying it would strain the state's Medicaid program 7.

What opponents say

Opponents argued that the measure would expand on current law, make late-term abortions easier to get and end parental notification requirements for minors 4. Opponents say the new language opens the door too wide, and Krystal Minera-Alvis of Nevada Right to Life said the group will continue the fight for life by lobbying the Legislature 1.

Planned Parenthood Advocates Mar Monte, which supported the measure, also said the fight continues. Its chief executive, Stacy Cross, said the group "will continue advancing access to reproductive healthcare across Nevada" 4.

Voter ID passed too, and Idaho went the other way

Nevadans also approved Question 7, a constitutional amendment requiring voter identification, with about 62% of the vote 4. Voters will have to either present photo ID when voting in person or provide other forms of identification 2. It takes effect in time for the 2028 presidential election, and lawmakers could start writing the rules in the 2027 session 4. Chuck Muth, a conservative commentator, called it "the only bright spot of the evening" 4.

In Idaho, voters rejected Proposition 1, which would have opened a legal path to challenge the state's near-total abortion ban. About 55% voted no 6. Idaho is one of 13 states that enacted total or near-total bans after the Supreme Court's 2022 decision, and some residents may still need to travel out of state for care 6.

The pattern is clear. Nevada now joins the states where abortion rights rest on a vote of the people rather than the makeup of the Legislature, starting Nov. 24 1.
