DOJ announces 63 noncitizen voting cases a day before midterms; 195 charged in 9 weeks

The Justice Department says it has charged 195 noncitizens in 25 states over nine weeks, including 63 people named Monday. These are charges, not convictions, and noncitizen voting is considered rare.

The Justice Department said Monday that it had charged 195 noncitizens in 25 states with illegal voting and registration offenses over the previous nine weeks. It also said 239 people have been charged with voting fraud-related offenses since the current administration took office. 1

The department announced charges against 63 people on Monday, one day before the 2026 midterm elections. These are accusations, not convictions. The defendants are presumed innocent unless proved guilty beyond a reasonable doubt. 1

Who is charged

Most of the 63 defendants were described as lawful permanent residents, also called green card holders. They can live and work in the U.S. permanently but cannot vote in federal elections. Four were identified as immigrants living in the country illegally. 1

North Carolina had the most defendants with 18, followed by California with 12, Tennessee with seven, and Texas and Pennsylvania with five each. 1

Some defendants are accused of voting once. Others allegedly voted over many years. Prosecutors accuse Elizabeth Margaret Crudup, a Kenyan national and green card holder in North Carolina, of voting in nine general elections and nine primaries between 2008 and 2026. 1

In California, prosecutors say Sirgalahad Camua, 43, a Filipino national and green card holder, registered in 2009 by falsely claiming citizenship and cast mail ballots in 2020, 2024 and 2026. They say he later denied registering when he applied for citizenship in 2025. 1

What the numbers do and do not show

The department's release did not provide a historical comparison to support calling these cases the largest recent surge. 1 Voting rights advocates and election experts have long said noncitizen voting is rare. The Heritage Foundation's election-fraud database recorded 24 cases from 2003 through 2023. 1

The charges come after earlier rounds. On Oct. 11, Fox News reported that the department had charged 64 foreign nationals in 17 states over roughly five weeks. 2 Fox also noted that authorities have not established that any of the identified cases changed an election outcome. 2

Fox also reported that in New Jersey, about 6,600 people who indicated they were not citizens were mistakenly registered through the state Motor Vehicle Commission. Fewer than 400 of them later voted, according to Gov. Mikie Sherrill's administration. 2

What happens next

The cases now move through the courts, where prosecutors must prove each charge. Election administration is handled mainly by state and local officials, not the federal government. 1

The timing matters. Critics may question whether these figures justify claims of a surge in voter fraud, and whether announcing charges the day before an election blurs the line between allegations and proven offenses. 1 That is analysis, but it is the question voters should keep in mind tonight if fraud claims surface. The Justice Department release did not say any of these cases affected a result. 1
